Status 4 June 08

The 2 June status conference did not result in any changes. Due to the ongoing settlement discussions the case was not set for trial. Another status conference is set for August 11, 2008, at which time the matter will probably be set for trial if it has not settled.

Again, investors are cautioned that the settlement discussions will not necessarily be successful. The parties have substantial differences at this point.

We are at risk of foreclosure on our home due to our loan to Mr. Brienholt. When the suit was filed, the State of Idaho promised to protect "alledged victims" or investors by retrieving loan payments. Does the warning on the SOI latest post indicate the investors will not be protected?

Why isn't Michael Brienholt facing criminal charges? Where is the justice in $1000 per month for 10 years? He has destroyed several families and has the nerve to address them as "friends" in emails.

The Dept of Finance does not bring criminal charges; that is up to the county prosecutor, or if the prosecutor chooses not to, the Attorney General's Criminal Division might.

Maybe he could sell off a few assets (i.e. over $1 million home and $400,000K cabin) to help repay investors. Seems like the decent thing to do.
